Terms of Service

These Terms of Service (“Terms”) govern your use of the Oak mobile application and related services (the “Service”) operated by Oak (“we,” “us,” or “our”).

By creating an account or using Oak, you agree to these Terms. If you do not agree, you may not use the Service.


1. Eligibility

You must be at least 13 years old to use Oak. By using the Service, you represent that you meet this requirement.


2. Description of Service

Oak is a subscription-based application that provides AI-powered fitness and nutrition guidance, including training programs, nutrition targets, and progress insights.


3. Medical Disclaimer

Oak provides fitness and wellness guidance only.

  • Oak is not a medical provider.
  • The Service does not provide medical advice, diagnosis, or treatment.
  • You should consult a qualified healthcare professional before making decisions related to your health, diet, or exercise.

You assume full responsibility for your health decisions and any outcomes resulting from your use of the Service.


4. Artificial Intelligence Disclaimer

Oak uses artificial intelligence to generate recommendations and insights.

  • AI-generated outputs may be inaccurate, incomplete, or inappropriate for your specific circumstances.
  • Recommendations are based solely on the information you provide and may not reflect your full health condition.

You are solely responsible for evaluating and acting on any recommendations.


5. Assumption of Risk

You acknowledge that:

  • Physical exercise and dietary changes involve inherent risks, including injury, illness, or other adverse effects.
  • You voluntarily participate in any activities suggested by Oak.

To the fullest extent permitted by law, you assume all risks associated with your use of the Service.


6. User Responsibilities

You agree to:

  • Provide accurate and complete information
  • Use the Service in a safe and reasonable manner
  • Not rely solely on the Service for critical health decisions

You may override any recommendation, and you are responsible for your choices.


7. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.


8. Subscriptions and Billing

Oak may offer paid subscriptions.

  • Subscriptions automatically renew unless canceled.
  • Billing is handled through Apple’s in-app purchase system.
  • You can manage or cancel your subscription through your Apple account.

Payments are non-refundable except as required by applicable law or Apple’s policies.


9. User Content

You retain ownership of the content you submit to Oak, including messages, logs, and other data.

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and analyze your content solely to:

  • Provide and improve the Service
  • Generate recommendations and insights

We may use aggregated and anonymized data for analytics and product improvement.


10. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes
  • Attempt to reverse engineer or disrupt the Service
  • Upload harmful, abusive, or fraudulent content
  • Interfere with other users or system integrity

11. Intellectual Property

All rights, title, and interest in the Service (excluding your content) are owned by Oak or its licensors.

You are granted a limited, non-transferable, revocable license to use the Service for personal use.


12. Third-Party Services

Oak may integrate with third-party services (such as Apple Health). For AI features, Oak may use OpenRouter, Anthropic, OpenAI, and other providers made available through OpenRouter. Use of these providers is governed by your in-app consent and our Privacy Policy, which describes what data may be sent and how it is used.

If you do not consent to third-party AI processing, or if you withdraw consent in the app under Profile -> Privacy & AI, AI chat and AI summaries are disabled.

We are not responsible for third-party services or their data practices beyond what these Terms and our Privacy Policy describe.


13. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms.

You may stop using the Service at any time.


14. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the fullest extent permitted by law, Oak disclaims all warranties, express or implied, including:

  • Fitness for a particular purpose
  • Accuracy or reliability of results
  • Availability or uninterrupted access

We do not guarantee specific outcomes from using the Service.


15. Limitation of Liability

To the fullest extent permitted by law:

Oak will not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

  • Personal injury
  • Loss of data
  • Loss of profits
  • Health-related outcomes

Our total liability will not exceed the amount you paid (if any) in the 12 months prior to the claim.


16. Indemnification

You agree to indemnify and hold harmless Oak from any claims, damages, or losses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your decisions based on recommendations

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.


18. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
